Cross Liability

A provision in liability insurance that treats each insured party as if they have separate insurance policies when one insured party makes a claim against another insured party. This coverage applies when multiple parties are named on the same policy but have a dispute or accident involving each other.

Example

When the general contractor accidentally damaged the plumber's equipment on a construction site, both covered under the same liability policy, cross liability coverage allowed the plumber to file a claim against the general contractor.

Memory Tip

Think 'Cross = Crossing swords' - when insured parties cross each other and have a dispute, this coverage treats them as separate entities for claims purposes.

Why It Matters

Cross liability coverage prevents disputes between business partners, contractors, or other jointly insured parties from leaving one party without coverage. Without this provision, insurance companies might deny claims between parties on the same policy, leaving significant financial exposure.

Common Misconception

Many assume that being on the same insurance policy means parties cannot make claims against each other or that coverage automatically applies in all inter-party disputes. However, cross liability coverage must be specifically included in the policy and typically excludes certain types of disputes like contractual disagreements or intentional acts.

In Practice

ABC Construction and XYZ Electrical are both named insureds on a $2 million liability policy with cross liability coverage. When ABC's crane accidentally damages XYZ's equipment worth $75,000, XYZ can file a claim against ABC as if they had separate policies. The insurance company investigates and pays XYZ's claim, treating ABC and XYZ as if ABC had caused damage to a completely separate, uninsured third party.

Etymology

The term combines 'cross' meaning intersecting or between parties, with 'liability' from Latin 'ligare' meaning to bind, reflecting the legal obligation between multiple insured parties.
