Curable Defect

A property defect or title issue that can be corrected or resolved through reasonable effort and expense, such as obtaining missing signatures, paying off liens, or making repairs. These defects do not permanently impair the property's marketability once addressed.

Example

The missing signature on the deed was deemed a curable defect that could be resolved by having the grantor sign an affidavit.

Memory Tip

Curable defect is like a curable disease - with the right treatment (action), it can be fixed and won't be terminal to your deal.

Why It Matters

Identifying curable defects allows buyers and sellers to negotiate repair costs or timeline adjustments rather than walking away from a transaction entirely, keeping deals moving forward.

Common Misconception

Many people assume any defect found during inspection is a deal-breaker, but most defects are curable and can be resolved before closing.

In Practice

A home inspection reveals a broken HVAC system, which is a curable defect, so the seller agrees to replace it before closing rather than lose the sale.

Etymology

From Latin 'curare' meaning 'to take care of' or 'to heal' combined with 'defectus' meaning 'lacking' - literally a lacking that can be healed or fixed.
